I have been married for 2 years and my wife has a defaulted student loan from before we met. My problem is that now they have put an intercept on my tax refund, and I am the only person working in our household. My wife had no income for the past 2 years, and I need to know if they can legally take the return that is based solely on my income since the student loan was in default prior to our marriage?
